Terms and Conditions

1. Who we are

In these terms, "we" and "us" means JJ Cornwall Scaffolding Ltd, and "you" means the customer named on the quotation, whether that is a homeowner, a builder, a main contractor or a managing agent.

2. Quotations and pricing

2.1 Every job is quoted individually in writing. The quotation sets out what is being erected, on which elevations, the number of lifts, the hire period included, and anything that would change the price.

2.2 No work starts until you have accepted the written quotation. A verbal figure given over the phone is an indication so you know roughly where you stand, and is not a quotation.

2.3 Quotations are valid for the period stated on the quotation. After that we may need to requote, because material and haulage costs move.

2.4 The quotation is based on the information available when it was prepared, including any photographs, drawings or measurements you supply. If the property, the ground or the access turns out to be materially different from that, we will tell you before we carry on, and clause 3 applies.

2.5 The tax treatment of the price, including whether VAT is chargeable, is stated on the quotation.

3. Additional work and changes on site

3.1 No additional work starts until its price has been confirmed in writing and you have agreed to it. This applies whether the change comes from you, from another trade on site, or from something we find when we get there.

3.2 If we find a condition that stops us building what was quoted, for example ground that will not take the load, an obstruction, or an elevation that cannot be tied as planned, we will stop, tell you what it means, and give you a written price for the alternative before doing anything else.

3.3 If you or another party on site asks for a change while we are there, we will price it and put it in writing. It will not appear on your invoice unless you have agreed it first.

4. Booking, access and start dates

4.1 Start dates are agreed with you and are given in good faith. Scaffolding work is affected by weather, by other trades finishing, and by access, so a date may need to move. We will tell you as soon as we know.

4.2 You are responsible for making sure we can get to the property on the agreed date, including access for a vehicle to unload, somewhere to stack materials, and clear working space along the elevations.

4.3 If we attend and cannot start through no fault of ours, for example the access is blocked, the area is not clear, or a permission is not in place, we may charge for the wasted visit at the rate stated on the quotation.

4.4 You are responsible for obtaining any permissions we need from third parties, including neighbours, landlords, managing agents or adjoining owners, where the scaffold needs to stand on or oversail their land.

4.5 Where a scaffold needs to stand on a pavement, verge or road, a licence is required from Cornwall Council. The quotation states who applies for it and confirms the cost. The licence is arranged before erection.

5. Your responsibilities during the hire

5.1 Do not alter the scaffold. Boards, ties, guardrails, toe boards and bracing must not be moved, removed or added to by anyone other than us or another competent scaffolder. If any part is moved, stop using the scaffold and ring us.

5.2 Tell us if it is struck or damaged, including by a vehicle, by weather, or by another trade. Do not use it until it has been checked.

5.3 Do not overload it. The scaffold is designed for the loading stated on the quotation. If you need to load out materials, tell us before we build it so it can be designed for that.

5.4 Keep it secure. While the scaffold is on your property you are responsible for taking reasonable steps to stop unauthorised access, particularly by children, and for telling your insurer that scaffolding is up if your policy requires it.

5.5 Sheeting and debris netting increase wind loading. Do not add sheeting, netting, banners or signage to a scaffold we have erected without asking us first.

5.6 The scaffold, and all materials and fittings in it, remain our property throughout the hire. You are responsible for loss of or damage to them while they are on your site, other than fair wear and tear or anything caused by us.

6. Hire period, extension and striking

6.1 The hire period included in the price is stated on the quotation. It runs from the day erection is completed.

6.2 If you need the scaffold for longer, tell us before the period ends and we will confirm the extension charge in writing. Extended hire is charged at the rate stated on the quotation.

6.3 When you have finished, ring or email us and we will book the strike. We cannot know the job is done unless you tell us.

6.4 If the scaffold cannot be struck on the agreed date because access is blocked or the area is not clear, hire continues until it can be removed.

7. Inspection, tags and documentation

7.1 Scaffold tags and handover documentation are provided on request at no extra charge. Ask for them and you will get them.

7.2 Statutory inspections during the hire can be arranged. Where these are carried out by us they are chargeable, and the charge is confirmed in writing before the inspection takes place.

7.3 Where you or a main contractor are responsible for inspections during the hire, that responsibility remains yours. If you are unsure who holds it on your project, ask us before the scaffold goes up.

8. Insurance and liability

8.1 We carry £10 million of public liability insurance. A copy of the certificate is available on request.

8.2 We are responsible for the scaffold being erected, altered and dismantled by competent people, working to TG20 and SG4.

8.3 We are not responsible for damage or loss caused by the scaffold being altered, overloaded, misused or accessed by others after we have handed it over, or by a failure to meet the responsibilities in clause 5.

8.4 We are not responsible for pre-existing defects in the building, including render, pointing, rainwater goods or roof coverings that are already failing, though we will point out anything obvious that we see.

8.5 Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law.

8.6 Where you are a business customer, our liability for any claim connected with a job is limited to the price of that job, and we are not liable for loss of profit, loss of contract or other indirect losses.

9. Payment

9.1 Payment terms are stated on the quotation and the invoice.

9.2 We may charge interest on invoices paid late, in line with the Late Payment of Commercial Debts (Interest) Act 1998 where you are a business customer.

9.3 Where an invoice remains unpaid, we may recover the scaffold after giving you reasonable notice.

10. Cancellation

10.1 If you are a consumer and you agreed the job away from our premises or at a distance, for example on site, over the phone or by email, you have the right to cancel within 14 days of agreeing it, without giving a reason.

10.2 If you ask us to start within that 14 day period and then cancel, we may charge for the work already done and any materials committed.

10.3 To cancel, email jjcornwallscaffolding@gmail.com or call 07984 611533. Telling us in writing is best, so the date is clear.

10.4 If you cancel or postpone after the 14 day period, or you are a business customer, we may charge for work carried out, materials committed and any wasted visit.

10.5 We may cancel a job if the site is unsafe to work on, if a permission or licence is refused, or if we cannot build a scaffold that meets the standard the job needs. If that happens we will tell you why and refund anything you have paid for work not carried out.

11. Complaints

If something is not right, ring 07984 611533 or email jjcornwallscaffolding@gmail.com and tell us what has happened. We would always rather hear about a problem while the scaffold is still up and we can do something about it.

12. General

12.1 These terms and any contract made under them are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.

12.2 If any part of these terms is found to be unenforceable, the rest continues to apply.

12.3 We may update these terms. The version that applies to your job is the version in force on the date of your quotation.

12.4 Nothing in these terms affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015.
